In 2015 McGovern & Greene LLP was retained by legal counsel of Sage Memorial Hospital in Ganado, Arizona. Navajo Sage Hospital is a tribal health care system on the Navajo Nation under the management of Razaghi Healthcare. The firm's assignment was to rebut findings reported in an alleged "forensic audit" commissioned by Indian Health Services ("IHS") of the accounting records of the Hospital. The audit had been used by IHS as the basis of a termination in the federal funding of the Hospital. Sage filed its own lawsuit against IHS to restore funding and to seek damages for the loss of the current funding.
Firm partner Craig L. Greene and his team examined in detail the findings of the forensic audit, as well as thousands of related documents. McGovern & Greene presented its examination findings in a formal Expert Rebuttal Report, which explained how the "forensic audit" was seriously flawed and not performed in accordance with professional standards. The Federal Judge in the Matter subsequently ruled that the Court was placing no reliance on the forensic audit commissioned by IHS.
Recently this matter was finally favorably settled for Sage Memorial Hospital for $200 Million with the Federal Government representing both a restoration of the funding and damages. The settlement was featured on National Public Radio and Arizona Station KJZZ.
